These Terms of Service (“Terms”) govern your use of the My Gel Studio iOS / iPadOS application (the “App”) and our website at https://mygelstudio.co.uk (the “Site”). By downloading, accessing, or using the App or Site, you agree to these Terms. If you do not agree, do not use the App or Site.

1. The service
App. My Gel Studio is a productivity tool for nail technicians and clients. Technicians may build and manage gel colour libraries, share access with clients using a unique tech code and approval flow, exchange in-app messages, and manage appointments (including integration with the device calendar where you allow it). The App may offer augmented reality (“AR”) features to preview colours in context. Clients may browse colours their technician makes available, communicate within the App, and use booking features as enabled by their technician. Certain technician capabilities require an active subscription purchased through the Apple App Store as described in the App and below.
Site. The Site provides information about My Gel Studio, links to download the App, and access to documents such as our Privacy Policy and these Terms. It is not a substitute for the App’s full feature set. We may update or remove Site content at any time.
2. Apple App Store & end user licence
If you obtain the App through the App Store, your use of the App is also subject to Apple’s applicable terms, including the Apple Media Services Terms and Conditions and the Licensed Application End User License Agreement (EULA) made available via Apple, as well as other Apple policies that apply. Those terms are between you and Apple Inc. For clarity: Apple is not responsible for the App’s content or support obligations, which are ours; Apple has no obligation to furnish maintenance or support for the App unless Apple chooses to.
Where Apple’s mandatory App Store terms and these Terms conflict on a point Apple requires, Apple’s terms control for that point. These Terms otherwise set out the rules that apply specifically to My Gel Studio as a service.
3. Eligibility
You must be at least 13 years old to use the App or Site. If you are under 18, you confirm that you have permission from a parent or guardian. You must comply with all laws that apply to you.
4. Accounts
You may need to create an account to use parts of the App. You agree to provide accurate information and to keep your login secure. You are responsible for activity under your account. Clients and technicians must not misrepresent identity or affiliation.
5. Subscriptions & billing (technicians)
Technician features identified in the App may require a paid subscription (for example Standard and Premium tiers, naming and features as shown in the App). Purchases, renewals, cancellations, and refunds are handled by Apple under Apple’s terms—not by direct payment to us.
- Auto-renewal: Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
- Free trials: If offered, trials convert to paid subscriptions at the end of the trial unless you cancel in accordance with Apple’s rules.
- Price changes: We may change prices with reasonable advance notice; changes take effect on your next renewal where permitted by Apple.
To manage or cancel a subscription, use your Apple ID subscription settings on your device; you may also use subscription management options presented in the App where available.
6. Acceptable use
You agree not to misuse the App or Site. For example, you must not:
- Use the App or Site for unlawful, harassing, defamatory, or harmful activity
- Attempt to gain unauthorised access to accounts, systems, or data of others
- Reverse engineer, decompile, or circumvent technical protections in the App (except where the law says otherwise)
- Use bots, scrapers, or high-volume automated access against the Site in a way that interferes with or burdens our systems, or harvests content without our prior written consent
- Deploy malware, overload infrastructure, or scrape or resell data in bulk without our written consent
- Use the App to send spam or unsolicited commercial messages outside reasonable client–technician communication
- Remove or obscure legal notices, or misrepresent your affiliation with My Gel Studio
7. Content & intellectual property
The App, Site, branding, and materials we provide are owned by us or our licensors and protected by intellectual property laws. You receive a limited, revocable, non-exclusive licence to use the App and to view the Site for personal or (for technicians) small-business operations in line with these Terms. You must not copy, distribute, publicly display, or create derivative works from our materials except as allowed by law or with our written permission.
You retain ownership of content you create (such as library entries, photos you add, or messages you send). You grant us a licence to host, process, sync, and display that content as needed to run the features you use (including through Apple’s services).
8. Third-party services
The App relies on third parties such as Apple (App Store, CloudKit, push notifications, device capabilities). Your use is also subject to Apple’s applicable terms and policies. We are not responsible for third-party services outside our reasonable control.
9. Disclaimers
The App and Site are provided “as is” and “as available”. AR and colour previews are for illustration and may differ from real-world appearance due to lighting, device, calibration, or camera limitations. We do not guarantee uninterrupted or error-free operation, or that results will meet your business outcomes.
To the fullest extent permitted by law, we disclaim implied warranties including merchantability and fitness for a particular purpose.
10. Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the App or Site.
Our total liability for any claim arising out of these Terms, the App, or the Site is limited to the greater of (a) the amount you paid us directly in the twelve months before the claim (if any—most payments go through Apple) or (b) £50, except where the law does not allow such limits.
11. Suspension & termination
We may suspend or terminate access to the App or Site if you breach these Terms or if we must do so for legal, security, or operational reasons. Provisions intended to survive (including ownership, disclaimers, and limits of liability) will survive.
You may stop using the App and Site at any time. Deleting the App does not automatically delete cloud data; use in-app account deletion or contact support if available.
12. Changes to these Terms
We may modify these Terms. We will post the updated version on the Site and update the date above. If changes are material, we may provide additional notice (for example in-app). Continued use after the effective date constitutes acceptance unless the law requires otherwise.
13. Governing law & disputes
These Terms are governed by the laws of England and Wales, subject to mandatory consumer protections where you live. Courts of England and Wales have non-exclusive jurisdiction unless your local law requires otherwise.
